Top Court Will Hear Challenge To California’s Prop 12 This Fall

As this year’s Supreme Court term comes to a close, pork producers are already looking forward to the next term when justices will hear a challenge to California’s Proposition 12.  Don Nikodim of the Missouri Pork Association says the lawsuit aims to bring regulatory certainty back to producers.

The National Pork Producers Council and American Farm Bureau Federation are challenging the ballot measure approved by 62 percent of California voters, which set minimum pen sizes for livestock whose meat will eventually be sold in the state.  The lawsuit received a boost when the Biden Administration filed a brief in support of the challenge, calling Prop 12 a violation of the Constitution’s Commerce Clause.
