Hog Farmers Anxious About Next Steps After California Wins Prop 12 Challenge

Farm groups went one-for-two this month at the U.S. Supreme Court, prevailing in a challenge to the EPA’s definition of Waters of the U.S. but failing to convince enough justices that California’s Proposition 12 was a violation of the Constitution’s commerce clause.  Missouri Farm Bureau vice president Todd Hays says it now means farms outside California who want to have their pork sold in that state will now need to provide at least 24 square feet for each sow in their herd.

Hays says the court’s 5-4 ruling means pork producers now face a difficult decision.

Missouri Farm Bureau vice president Todd Hays is a hog producer from Monroe City.
