Accused Moberly Murderer Due in Court in February

The Moberly man accused of murdering another in early July is due back in court February 2nd. 79-year-old Jerry Fitzwater of Moberly has pleaded not guilty to first degree murder, armed criminal action, and unlawful use of a weapon in the death of 49-year-old Mitchell Nickerson of Moberly. Moberly Police found Nickerson with a bullet hole near his temple along East Burkhart. Fitzwater told police he did not know Nickerson by name, but admitted he shot him because he believed Nickerson was a drug dealer who had sold drugs to children. His disposition hearing was continued from Wednesday.
