MILLER PLEADS GUILTY TO THIRD DEGREE ASSAULT



A Moberly woman accused of kicking her son multiple times and throwing him against a wall has pleaded guilty to third degree assault, a misdemeanor.

Randolph County Prosecutor Mike Fusselman says 28-year-old Elizabeth Christine Miller was sentenced to six months in jail; however, the sentence was suspended and Miller has been placed on two years probation. As part of the plea agreement, Fusselman dropped two counts of child abuse and amended it to third degree assault:

Fusselman tells Superstation KRES Miller must follow the plan of the Children's Division and the Juvenile Office. The plan is called the Family Reunification Plan:

The Moberly Police Department's probable cause statement says Miller allegedly pushed one of the children down from behind because he wasn't walking fast enough. Miller also allegedly kicked her older son in the ribs while he was lying on the floor.
